It’s easy to get confused by these and other very similar names. Unscrupulous producers often use them interchangeably to market products that may not actually contain any active cannabinoids at all. And it’s these differences that make it possible to make and sell hemp products in ways that cannabis products can’t be marketed.\n\nThe cannabis plant family includes both _Cannabis sativa_ and _Cannabis indica_ strains, as well as a few lesser-known strains. Hemp comes from a variant of _Cannabis sativa_, too. But this one has been cultivated to have very low levels of THC. To be considered hemp by U.S. law—and therefore legal to grow and sell—a hemp plant must not test at more than 0.3% THC.  \n\nHemp is used all over the world in many industries, including to make rope and clothing, but in the U.S., [it also became entangled in the war on drugs](https://news.medicalmarijuanainc.com/hemps-current-legal-status-u-s/) just like its cousin, the THC-rich cannabis species. This makes it very appealing to people living in states where medical cannabis isn’t available.\n\nAnd now, the demand for CBD-rich hemp products has led to an explosion of products from around the world, particularly the U.S., Europe and China, with widely varying levels of quality and safety. \n\n### How to Find the Best & Safest Hemp Products\n\nCBD-rich hemp products may not be as potent as medical-grade cannabis extracts, but they can be useful for relieving symptoms of many of the same health conditions. The hemp plant is a bioaccumulator—meaning, it absorbs chemicals from the soil, which accumulate in the plant’s tissues. Depending on the area, hemp plants can absorb:\n\n* pesticides\n* fertilizers\n* heavy metals\n\nAnd all of these things can be passed along to consumers. \n\nThe safest hemp products are those that have been grown under organic conditions in areas where hemp cultivation has a long tradition, such as Europe, which tops the list of quality sources for hemp products. This means for the most part it’s regulated similarly to diet supplements and vitamins and can be sold all throughout the country. \n\n### How Does Hemp CBD Oil Treat Medical Conditions in Children?\n\nWhen it comes to treating children with CBD, epilepsy and seizures in general have been the most notable health conditions the oil seems to help with. There’ve been many clinical trials and lab research to indicate CBD is an effective treatment for seizures. \n\nSeizures are caused when brain cells misfire, which cause the body to convulse and can lead to loss of consciousness, injury and brain damage. So why is CBD so effective in treating seizure conditions? \n\nSome researchers believe that CBD interacts with:\n\n* endocannabinoid receptors \n* calcium and sodium ion channels \n* glutamate receptor antagonists\n\nIn this theory, the anticonvulsive properties of CBD attach to neurons in the brain and inhibit how the ions flow between neurotransmitters. Unfortunately, this is only a theory, and much more research must be conducted to fully understand the science behind the anticonvulsive properties of CBD. \n\n### Does Hemp CBD Work Better Than Traditional Treatments Do?\n\nEvidence from lab research, clinical trials and anecdotal stories have all shown positive signs that cannabis can help with epilepsy. Especially in extreme cases in which doctors, equipped with only pharmaceutical treatment options, have essentially conceded the battle. \n\nAnd even if anticonvulsive pharmaceutical drugs like valproic acid, primidone, clonazepam and phenobarbital are effective against seizures, they come with some pretty serious side effects that can do real damage to young, developing children. These drugs are known to result in: \n\n* Nausea \n* Hair loss \n* Liver failure \n* Depression \n* Weight gain \n* Irritability\n* Sedation\n* Mood disorders\n* Impotence\n\nLuckily, right now there’s more scientific attention on CBD as a natural treatment for epilepsy than there has ever been. And in a monumental move, the FDA just approved Epidiolex, a CBD-based syrup to treat seizures associated with Lennox-Gastaut syndrome and Dravet syndrome. \n\nAmong the rigorous testing to receive FDA approval was [a double-blind, placebo-controlled study that was published in _The New England Journal of Medicine_](https://www.nejm.org/doi/full/10.1056/NEJMoa1611618) and funded by GW Pharmaceuticals, the maker of Epidiolex. In this study, 120 children and teenagers with Dravet syndrome were divided into two groups: one treated with the CBD oral solution and the other treated with a placebo. The groups were treated for 14 weeks with either 20 mg of CBD per kilogram of body weight per day or the placebo. \n\nAfter 14 weeks, the group taking CBD saw a reduction in seizures per month from 12.4 to 5.9 (median). This is compared to a decrease from 14.9 to 14.1 (median) when treated with the placebo. Sixty-two percent of caregivers in the CBD group reported that the child’s overall condition improved, compared to just 34% in the placebo group.\n\nThe results of this study led the lead researcher Orrin Devinsky, to conclude, “This study clearly establishes cannabidiol as an effective anti-seizure drug for this disorder and this age group.” \n\nThese subjects had very difficult cases, in which their seizures were extremely drug-resistant, rendering traditional treatments pretty much ineffective. And compared to the side effects of traditional drugs, in this study the most reported side effect was sleepiness. For this group of patients to see success using a natural extract is revolutionary. For them, CBD was certainly more effective than traditional treatments were. \n\n### Can I Legally Give Hemp CBD to My Kid?\n\nHemp CBD oil is legally much more accessible than CBD oil is. The difference between hemp-derived CBD and cannabis-derived CBD can be confusing, but according to a Drug and Enforcement Agency (DEA) spokesperson, “If the products are derived from the non-psychoactive part of the marijuana plant, then you’re talking a non-controlled substance.”  If these requirements are met, then hemp CBD oil can be legally sold all throughout the United States. \n\n### How Does a Parent Get Hemp CBD Oil for Their Kid?\n\nFinding hemp CBD oil is relatively simple. You can find it in most cities and towns across America, often at organic food stores and holistic shops or through a state program. Hemp CBD oil can also be legally shipped anywhere in the U.S.\n\nBut parents should do research on a specific brand before buying, especially since these oils have relatively lax regulations on their ingredients and production methods. You always want to make sure there aren’t any harmful additives or questionable production methods employed when processing the hemp oil.\n\nThe real struggle for many parents occurs after purchasing the CBD. How do you use it? How much is enough? How much is too much? First of all, discuss hemp CBD oil with your child’s doctor before you do anything. They may have suggestions for dose and treatment or hopefully some kind of general guidance to give to you.\n\nUnfortunately, not many doctors are fully versed in the latest science and research on CBD. That’s when he introduced Senate Bill 2667, known as [The Hemp Farming Act of 2018](https://www.govtrack.us/congress/bills/115/s2667/summary). It was rolled into the Farm Bill, which [passed on June 28](https://www.upi.com/Senate-passes-bill-legalizing-hemp-as-agricultural-commodity/5531530229618/).\n\nSupporters say that making hemp legal will help bolster economies in agricultural states and pave the way for more research on the plant. It will also enable consumers to purchase hemp products without fear of governmental reprisal.\n\nThe bill, which needs to be merged with another House bill before it goes to the Oval Office for President Trump’s signature, would legalize hemp. It would remove its status as a controlled substance, enabling farmers to grow hemp and sell it as a commodity. States would have the ability to regulate hemp production, and hemp farmers would be eligible for crop insurance.\n\n\"It's time to figure it out and see where this market will take us,\" Sen. McConnell said to the Senate Agricultural Committee in June.\n\n\"I think it's an important new development in American agriculture. There's plenty of hemp around; it's just coming from other countries. Why in the world would we want a lot of it to not come from here?” he continued.\n\nFOLLOW US ON [FACEBOOK](https://www.facebook.com/pg/hellomdcompany/posts/) & [INSTAGRAM](https://www.instagram.com/hellomd_com/?hl=en)\n\n### What Is Hemp & How Is it Related to Cannabis? \n\nYou may already see a variety of hemp products in supermarkets and other retail stores, including: \n\n* Edible hemp seeds\n* Clothing \n* Personal care products \n* Cooking oil \n* Building materials \n\nThey’re manufactured from a species of cannabis known as _Cannabis sativa_ L. (Cannabaceae), a relative of the cannabis plant that’s used to create the psychoactive products sold at your local dispensary. This “industrial hemp” is related to _Cannabis sativa_, but has one significant difference: It contains only a tiny fraction of tetrahydrocannabinol (THC)—usually less than 0.3% and so isn’t psychoactive. \n\nFor many people, it would be very difficult to visually distinguish between what we’ll call hemp vs. cannabis. The italicized word _Cannabis_ is the actual biological name for both plants, and throughout the world, there are dozens more related species.\n\nCannabis cultivators wishing to emphasize the psychoactive effects of cannabis have focused on the production of plants rich in resinous cannabinoids like THC and cannabidiol (CBD). On the other hand, hemp farmers have bred their plants to produce tough fibers and plump, oil-filled seeds.\n\n### Hemp’s Long Strange Trip as an Agricultural Crop \n\nSen. McConnell wasn’t incorrect in advocating for the legalization of hemp. Its history as a diverse and useful crop is nearly as old as human history itself.\n\nOver thousands of years, hemp was cultivated from cannabis plants to encourage the growth of tall, fibrous stalks and the oily seeds. They were used to create rope, paper, oil and animal feed. It’s thought that hemp seeds travelled with early Asian civilizations, with records of Chinese cultivation dating back 8,500 years. \n\nIn the U.S., McConnell’s home state of Kentucky was the country’s leading hemp producer from the mid-1800s until about 1912. It was used as a source for rope and sail cloth. At that time, hemp was called “the king of fiber-bearing plants, the standard by which all other fibers are measured.” But by 1938, with the rollout of marijuana prohibition, the production of hemp in the U.S. disappeared.\n\n### Canada Takes the Lead in Hemp Production\n\nLast year, the U.S. imported $67 million in hemp—mostly seeds used to make other products—and Canada supplied 90% of it. Canada, which strictly regulates hemp farming, has allowed commercial licenses for hemp production since 1998.\n\nCanada had 140,000 acres in hemp cultivation in 2017 and has greatly simplified its regulations for farmers who want to grow hemp. It’s been legal to import hemp into the U.S. since 1998, which is one reason Canadian hemp products made such dramatic inroads into the U.S. market.\n\n### Hemp Can Thank CBD for Its Possible Legalization\n\nThere’s a compelling reason why Sen. McConnell powered his hemp proposal through Congress: the [growing popularity of cannabidiol (CBD)-infused products](https://www.rollingstone.com/politics/features/mitch-mcconnell-drug-warrior-cbd-champion-w522206). Although the Senator doesn’t publicly champion CBD, it should be noted that Kentucky, the state Sen. McConnell represents, grows industrial, low-THC hemp through university and agriculture pilot programs. \n\nThe positive shift in public perception regarding cannabis, combined with glowing reports of CBD’s effectiveness in treating certain types of seizure disorders, has resulted in staunch opponents of cannabis taking a more lenient approach to hemp-based CBD products. The hemp oil derivatives you may start to see in traditional retail outlets, if hemp is legalized, will be made from industrial hemp, and not cannabis.\n\n### I’m Confused—Are High-CBD Cannabis Strains Considered Hemp?  \n\nNo. Charlotte’s Web, the strain made famous by Colorado’s Stanley Brothers, was named for the young girl who was featured in Sanjay Gupta’s groundbreaking 2013 CNN documentary, “[Weed](https://www.youtube.com/watch?v=CiShwotFJR8).” When Charlotte’s parents discovered that a low-THC, high-CBD cannabis strain massively curtailed her seizures, marijuana cultivators worked to develop more high-CBD strains. These strains include: \n\n* [ACDC](https://www.hellomd.com/strains/5a7cbe97d520d60009f4f4a5/acdc)\n* [Harlequin](https://www.hellomd.com/strains/5a9d9ad8fdb6dd00088d0cf1/harlequin)\n* [Cannatonic](https://www.hellomd.com/strains/5a7ce5dcd520d60009f4f4bd/cannatonic)\n* [Sour Tsunami](https://www.hellomd.com/strains/5b313d1e9755250007f2aeaa/sour-tsunami) \n* Ringo’s Gift\n\nBut all of these strains originate from THC-containing cannabis plants. \n\nBecause CBD is found in both industrial hemp and psychoactive forms of cannabis, manufacturers have created hemp-based CBD oils, which is why this issue can be confusing to the consumer.\n\n### Are All Hemp CBD Oils the Same?\n\nNo. Legalization advocates hope that hemp will fall into a regulatory process like psychoactive cannabis. Currently, there are far fewer regulations regarding the manufacturing and formulation of industrial hemp-based products. They’re regulated by the Food and Drug Administration as a dietary supplement.\n\nBut the market is already flooded with everything from excellent CBD products to the equivalent of snake oil—hemp products made with less than healthy additives from questionable sources. \n\nRELATED: [HEMP OIL VS. Some importers sell less-than-optimal hemp paste and powder to manufacturers, and many of the end results of these questionable products can be found online.\n\nThis sub-optimal hemp usually requires the addition of thinning agents if used in an item like a vape pen. Beware of any cannabis product that uses propylene glycol as a thinning agent. It’s often used in conjunction with unregulated “pure CBD oil” and is harmful to healthy cannabis consumers, and particularly unhealthy for medical marijuana patients.\n\n### Will Hemp CBD Work the Same for Me as Cannabis-Based CBD Products Will? \n\nLike all products used by patients for self-care and wellness, it’s important to consider the source of your medicine. Look carefully at the labels and note whether your hemp-based CBD product has been tested in the same way as your psychoactive cannabis has. A quality hemp product will be tested for pesticides, molds and cannabinoid profiles.\n\nThe best way to know if hemp-based CBD medicine works for you is to experiment. Some people have excellent results from hemp-based CBD medicine, and others respond better to CBD medicine from cannabis plants.\n\nAnd remember: Hemp is the source for an ever-growing list of excellent products like soaps, lotions and food items that are just plain good for the body and soul.\n\n`embed: https://www.youtube.com/watch?v=DZOIBjVdeYc`\n\nSen. This was all in an effort to design a product that celebrated the botanical actives in the cannabis plant the way I had celebrated the botanicals in cacao, while also making sure it was approachable to an emerging consumer.\n\n### Tell us about your tincture called “Nude” that’s cannabidiol (CBD) derived from hemp. Why did you decide to create a hemp-derived tincture in addition to your tetrahydrocannabinol (THC) tinctures?\n\n**JZ:** I realized during a few months of sampling my THC products with diverse groups in the San Francisco Bay Area that the majority of our groups were curious, but apprehensive about using cannabis. This confusion has hobbled hemp production in the United States for nearly half a century. It’s also contributed to misunderstandings about the uses and benefits of products derived from various parts of the _Cannabis sativa_ plant.  \n\nHemp and cannabis are both varieties of _Cannabis sativa_. They both contain common cannabis compounds and terpenes, including CBD and tetrahydrocannabinol (THC). But hemp, also referred to as industrial hemp, contains only trace amounts of THC—less than 0.3%. So, it has no psychoactive properties and can be sold even in places where cannabis is still illegal.  \n\nHemp has been cultivated around the world for thousands of years for agricultural and industrial uses ranging from making rope and clothing to animal feed. Today it’s used for those and many other purposes including replacing petroleum products in paint and plastics, and as fuel and construction material. Like other nuts and seeds, hemp seeds are also rich in essential fatty acids and proteins, making them a popular nutritional supplement. \n\n### Hemp’s Relationship With the War on Drugs \n \nBut [hemp got caught up in the war on drugs](https://news.medicalmarijuanainc.com/hemps-current-legal-status-u-s/) that made cannabis a controlled substance of the highest order. In the early years of the 20th century, hemp and cannabis were both cultivated and processed legally in the United States. But the Controlled Substances Act of 1970 placed _Cannabis sativa_ on its Schedule 1, along with heroin and LSD. All of these substances are classified as having significant potential for abuse without any redeeming medical qualities. \n\nBecause hemp is just a variety of _Cannabis sativa_, it went right along with cannabis onto Schedule 1. This means that hemp cultivation and research are prohibited in the U.S. But an odd loophole in the Controlled Substances Act excluded seeds, stalks and the oil extracted from hemp. So, this is why you see products made from imported hemp for sale all over the country even though hemp cultivation is illegal. \n\n### CBD Oil & Hemp Oil Come From Different Sources\n\nThe leaves and flowers of the _Cannabis sativa_ plant contain the highest quantities of all its compounds, and that accounts for its medical and recreational effects. CBD oil extracted from these parts of the plant typically contains high levels of CBD, but it can also contain some THC. These oils are often called cannabis oils to distinguish them from oils that contain only CBD and have no psychoactive properties at all. \n\nHemp oil is made from hemp seeds and/or stalks of the plant. That’s why it can get around the restrictions of the Controlled Substances Act. But that’s also why it may not make the best medicine. The seeds and stalks—where the hemp oil comes from—don’t contain many cannabinoids. If hemp oil is naturally low in THC, it’s also a comparatively poor source of CBD. \n\n### CBD Oil & Hemp Oil Have Different Benefits \n\nBy its very nature, hemp oil does contain CBD, but it takes a lot of hemp to make oil with enough CBD to produce its well-documented effects. For this reason, hemp oil products generally don’t have the [anti-inflammatory, antibacterial and immune-boosting properties to the level that cannabis-derived CBD oil does](https://www.npr.org/sections/health-shots/2018/04/23/604307015/anxiety-relief-without-the-high-new-studies-on-cbd-a-cannabis-extract).  \n\nHemp oil does support immune health, and that’s why it’s widely sold as a nutritional supplement. Like other healthy oils, it contains the omega-3 fatty acids that help prevent oxidation in cells and contribute to the flexibility of the circulatory system. Hemp oil also contains omega-6 fatty acids and linoleic acid, which also act as antioxidants and benefit the cardiovascular system. \n\n### What About Side Effects & Risks With Cannabis Oil & Hemp Oil?\n\nHemp production and research in the U.S. are still restricted, so there’s limited information on its side effects and risks. But that could change with the passage of a new bill called the [Hemp Farming Act, proposed by Sen. Mitch McConnell (R-KY)](http://www.businessinsider.com/what-is-hemp-different-from-weed-2018-3). The bill seeks to legalize industrial hemp and classify it as an agricultural product. For now, most hemp oil products are manufactured outside the U.S., with varying levels of oversight and quality control.  \n\nUnless you’re allergic to hemp or cannabis, [there are few reported side effects of consuming these oils](https://www.consumerhealthdigest.com/cbd-hemp-center/hemp-oil-side-effects.html). That said, hemp oil has a few extra risks, related largely due to the nature of the hemp plant itself and the way it’s often processed.\n\nBecause quality standards around hemp oil are limited, it can be hard to find out how much CBD is in a particular product—and the content can vary considerably from seller to seller. Hemp oil can also be processed using toxic substances such as ethanol, which can leave traces in the oil. Because CBD oil production typically begins with high-CBD cannabis leaves and flowers, this kind of oil has a higher CBD content than hemp oils do, so it typically offers more of CBD’s potent healing benefits.\n\n### How to Use Hemp & CBD Oils\n\nYou can consume both CBD oil and hemp oil by itself, or you can add it to foods. Hemp is a great way to introduce many skeptical people to cannabis, because the benefits of the plant can be separated from its ability to produce psychoactive side effects. The increasing amount of products shows cannabis’ growing appeal among the public because people are more open and willing to reach for these new beauty products that feature hemp leaves front and center on the packaging. \n\n### The Medical Community Says...\n\nThough the formal dermatologist community has not embraced cannabis yet, it may be soon on its way. Tamás Bíró, PhD, director of the immunology department at the University of Debrecen in Hungary has done research on the potential of cannabis at targeting the endocannabinoid system in and through the skin. He says, “the skin barrier, which is very important for moisture retention, sebum production, and sweat-gland function, as well as skincentric sensory functions such as pain and itch. The new law allows hemp to be sold and transported in the state as part of a new pilot program. This has come on the heels of a 2014 law that allows farmers and universities to be involved in the research of industrial hemp in the state.\n\nJD Farms, which is working in association with Morrisville State College, has planted the first hemp crop in the state of New York in 80 years. The crop was planted on 30 acres, and it’s being grown for industrial purposes ranging from paper to clothing to food products such as hemp oil and hemp seeds. The popularity of hemp-based food products has grown in the past few years as people have recognized the nutritional value of hemp.\n\n### Hemp’s Rise in the United States\n\n[Hemp has a storied past](http://www.hemphasis.net/History/harriedhemp.htm) in the United States. The plant was originally the material of choice for maritime uses like sails and cord, because of its natural resistance to decay. Due to its utility, hemp was one crop that always traveled with pilgrims to the Americas, and it became a critical part of the new colonial economy.\n\nHemp was used to create products such as fabric, yarn and rope, most of which were sent back to Britain. After the revolutionary war, all citizens of the new republic were encouraged to grow hemp. It was such an important commodity that people were even allowed to pay taxes with it. \n\n### The Demise of Hemp in the 1930s\n\nDespite the fact that hemp farming and production are highly efficient, and the plant created a superior product, cotton began to take over when it came to cloth and sail-making. Meanwhile, wood pulp began to dominate the paper industry. Though its popularity declined, reliance on hemp was still encouraged during World War I to aid in the war effort.\n\nHowever, it was the 1930s that marked the demise of hemp. With the introduction of reefer madness, the cannabis stigma became associated with hemp as well—since cannabis and hemp both come from the cannabis sativa plant, albeit from different varieties. This decreased hemp’s popularity as a crop.\n\nThe final blow to hemp came with the Marijuana Tax Act of 1937. This tax act applied to marijuana and hemp; it regulated the hemp industry so much so that it no longer became a profitable crop choice for farmers. Here's what consumers need to\r\nknow about this ancient plant.\r\n\r\n### What Is Hemp?\r\n\r\nContrary to what many people think, hemp isn't simply the cast-off\r\nportion of psychoactive cannabis plants. There are many types of\r\ncannabis plants, and hemp is simply a variety of non-psychoactive\r\ncannabis. While hemp and psychoactive marijuana are technically born\r\nfrom the same species, they're differentiated by their chemical makeup\r\n(hemp contains less than 1% THC), uses and growing methods.\r\n\r\n### What Is Hemp Used for?\r\n\r\nFor thousands of years, hemp has been used to produce textiles, paper,\r\nclothing and household products. The plant offers a source of renewable\r\nmaterials for use in thousands of industries. This classification makes hemp illegal for cultivation\r\nin the U.S. Though hemp is grown widely in other countries such as Canada, the U.S. is forced to import all hemp due to the 1970 act.\r\n\r\n### The Future of Hemp\r\n\r\nAs of 2014, states that have developed their own set of industrial hemp\r\nrules and regulations have been allowed to grow hemp for research\r\npurposes. This amendment to the U.S. Farm Bill resulted in states like\r\nOregon and Colorado pioneering hemp agriculture efforts.\r\n\r\nIn early 2015,\r\na bill called the [Industrial Hemp Farming\r\nAct](https://www.congress.gov/bill/114th-congress/senate-bill/134/cosponsors)\r\nwas introduced to the Senate and the House. If the bill passes, it would seek to remove the long-standing restrictions on the production and sale of industrial hemp by removing\r\nthe crop from the list of Schedule I controlled substances.\r\n\r\nAccording to Rep. Jared Polis, a Colorado-based democratic sponsor of the bill, \"The\r\nfederal ban on hemp has been a waste of taxpayer dollars that ignores\r\nscience, suppresses innovation and subverts the will of states.\"\r\n\r\nAs it stands now, the U.S. is the world's single largest consumer of\r\nhemp products—and the only major developed country that outlaws production of hemp. Whole hemp seeds haven't had their outer hulls removed, so they're in a less processed state. Because their outer hulls are still intact, whole hemp seeds also have significantly more dietary fiber—in particular, insoluble fiber —than hulled seeds do. Dietary fiber is important for maintaining digestive health, and it also plays a role in lowering your cholesterol and blood sugar levels.\n\nHulled hemp seeds, also called hemp hearts, are easier to digest and generally more palatable. They also have less total fiber. Because they lack the protection of the outer hull, they also tend to go rancid sooner than whole seeds do. So, storing them in the fridge or freezer over the long term is a good idea. Both varieties have excellent nutritional value.\n\n### The Health Effects of Consuming Hemp Seeds\n\nSuperfoods can positively impact your health. For hemp seeds, those positive effects start with heart health. It can be used to treat nausea and vomiting, seizures, anxiety, depression, psychosis, inflammation, and the list goes on. When taken in combination with tetrahydrocannabinol (THC), the cannabinoid responsible for causing a euphoric high, marijuana has been shown to [reduce brain tumors](http://www.gwpharm.com/oncology.aspx) as well as [shrink breast tumors](http://www.ncbi.nlm.nih.gov/pubmed/22776349) in animal subjects.\n\nBut because a majority of CBD comes from the marijuana plant, it often falls under the classification of a Schedule I narcotic. Its use and availability are therefore restricted to those states with medical marijuana laws.\n\nAs of September 2015, 28 states, the District of Columbia and Guam have passed medical marijuana legislation. These products are legal, because they’re made from the hemp plant and not marijuana.\n\nSo, what’s the difference between cannabis CBD and hemp CBD? And why is one restricted and the other not?\n\n### The Most Studied Cannabinoids: THC & CBD\n\nThe two most abundant cannabinoids in cannabis are THC and CBD. Their abundance and the euphoria-inducing effects of THC make them the most studied compounds in the plant. This is why many scientists have attempted to manipulate the plant’s compounds or increase the concentration of CBD while, at the same time, decreasing THC levels. Their goal: to enhance its medical effects while reducing its psychoactive effects.\n\n### CBD Derived From Hemp\n\nIt makes sense then, that scientists looked at hemp as a possible solution to finding a much higher balance of CBD to THC.\nHemp is a variety of the cannabis sativa plant, which [contains very little THC (0.3% or less)](http://www.ers.usda.gov/media/328202/ages001eb_1_.pdf) and [has a higher ratio of CBD to THC than marijuana does](http://www.alternet.org/drugs/whats-difference-between-hemp-and-marijuana).\n\nRELATED: [6 REASONS TO CONSUME HEMP CBD](https://www.hellomd.com/health-wellness/5b64b6c7a1805500087dba2f/6-reasons-to-consume-hemp-cbd)\n\nHemp has been used for centuries for clothing, sailcloth, rope, paper, medicine and cosmetics. Modern uses include plastics, food, animal food, animal bedding, construction, nutritional supplements and essential oils.\n\nPrior to World War II, hemp was one of the biggest agricultural products in the United States. However, farming and production began dropping after the [Marijuana Act of 1937](http://definitions.uslegal.com/m/marijuana-tax-act%20/), and it\nbecame illegal in 1970.\n\n[Hemp products, however, can be imported as long as the product comes from plants that contain less than 0.3% THC](https://www.projectcbd.org/article/cbd-misconceptions) and are derived from the seed or stalk of the plant rather than the leaves or flowers.\n\nWhen the benefits of CBD started becoming known, companies around the world began creating hemp-based CBD-concentrated oils. These products are legal to buy and use in all 50 states as long as the product adheres to the import rules regarding THC. Although this sounds like a good\nsolution to the problem of providing high-CBD and low-THC products, there’s a problem: a lack of quality control.\n\n### Does Hemp-Based CBD Pass Muster, and Is It Safe? It Depends\n\nIn the U.S., drugs must undergo rigorous testing and quality checks before they can make claims about effects and be put out on the market. This isn’t true in many other countries, and in February 2015, the [U.S. Food and Drug Administration](http://www.fda.gov/NewsEvents/PublicHealthFocus/ucm435591.htm) issued several warning letters to hemp-based CBD manufacturers regarding their medical claims.\n\nWhile these products were being sold as dietary supplements, which have fewer restrictions than drugs do, the manufacturers were making a number of medical claims, including ones that stated that their products could treat, cure or prevent a number of diseases including cancer. Even worse was that scientific evaluation of their chemical components revealed that many of the products contained little or no CBD despite being labeled as a CBD-containing product.\n\nQuality control issues also revealed that some imported hemp-based CBD oils contain other unwanted chemicals, such as [pesticides and heavy metals](http://www.unitedpatientsgroup.com/blog/2015/07/29/cannabis-cbd-hemp-cbd-whats-the-difference-whats-legal-by-marys-nutritionals/). Additionally, because CBD levels in hemp are still lower than those found in cannabis, it requires large amounts of hemp plants to produce CBD oil, which increases the risk of\n[contaminants](https://www.projectcbd.org/article/cbd-misconceptions).\n\nThere have been some reports of [side effects associated with hemp-based CBD oil](http://www.worldhempoil.com/cbd-faq.html) such as:\n\n-   Stomach upset\n-   Dysphoria (distorted mental state) in high doses\n\nThat said, some quality hemp-based CBD products can provide relief for patients. Yet, leaders in the medical marijuana community claim that marijuana-derived CBD holds more medicinal benefits because of the other cannabinoids present.\n\n### Is Hemp Made in the USA?\n\nMany of the states that have passed medical marijuana legislation have passed CBD-only laws in an effort to reduce access to the intoxicating effects of THC. This means that the demand for CBD-based products is going to increase.\n\nIn 2014, [federal legislation lifted the ban on hemp farming](http://www.votehemp.com/PR/2014-02-07-vh_farm_bill_signed.html) in states that had begun to legislate hemp research. Thirteen states have passed laws establishing commercial industrial hemp programs, and another seven have approved programs for the agricultural and academic research of hemp. What this means is that hemp-based products that have undergone rigorous testing and quality control may become available on the market.
